Jacob Funk's - Last Will and Testament - 19th day of August 1822

Birth:      October 13, 1737  in Woodstock, Shenandoah County, Virginia
Married: October 11, 1772 in Woodstock, Shenandoah County, Virginia
Military:
Jacob did not participate in the Revolutionary War
               some of his sons may have participated in the 1812 militia in the area
Death:    1822 in Harrison County, Indiana
               ?? March 12, 1822
               ?? Grave marker says February 19, 1819
Will:        Dated August 19, 1822 and proved October 3, 1822
Burial:     Family plot on his farm at the mouth of Indian Creek in Harrison County, Indiana
 

A stone bearing the following inscription marks the grave of Jacob Funk:

Jacob Funk's Will

In the name of God Amen

 

I Jacob Funck of the County

of Harrison and State of Indiana

being sick of body but of perfect mind and

memory thanks be to God for it calling to

mind the mortality of my body and that it is

once appointed for all men to die, do make

this and ordain this my last Will and Testament

revoking all former and others Wills & Testaments by me made or done, and constitute

as follows and first.  I recommit myself to God that gave it and my body to the grave to be buried in a Christian like manner according to the dis-

charge of my executor, and as touching my

worldly estate where with for hath pleased

God to bless me with in their live I give and

bequeath in the following manner. Item 1.  I

give and bequeath to my son Isaac eight five

acres of land all so I give to my son Abraham

seventy five acres of land also to my

William ninety five acres of land also

to my Daughter Liddy eight acres of land

also out in Lot No 29.  Also to my daughter

Sary Barkison hence in lots of land lying in

Amsterdam which she has to pay for the three

lots thirty six dollars  Lots numbers as follows

No. 24, 25, 26  My daughter Liddy has to pay

for him eight acres of land and one in Lot

One hundred dollars  also I charge my daughter

Catharine forty five dollars for moving her from Shenandoah County in Virginia to the state of

Indiana.  Also I charge my daughter Elizabeth

two hundred dollar of money that she received

out of my legacy.  Also I charge John Wall

two hundred and forty five dollars due on a bond,

 

 

 

also the hundred hundred and seven dollars

of interest arising from the same.  Also the

said John Wall is to pay to each of the

children fifty dollars out of their Mother's

legacy of the money that was lent to you by

Jacob Funck.  Jacob Wall fifty dollars at a

lawful age  George Wall fifty dollars at a

lawful age also John Wall fifty dollars at a

lawful age also Elizabeth Wall fifty dollars at a

lawful age also Polly Wall fifty dollars at a

lawful age the balance to said John Wall is

to keep for that is all he is to have out of my

estate paid for Jacob Funck the Gunsmith

to Joseph Shoving(?) and John Byle and Phillip

Huffman one hundred and eight two

dollars  paid to wards his legacy also

if he ever comes to this place again he is

to have the benefit of all the lots that now

remain unsold in Amsterdam, executing the two

lots No. __  If the said Jacob Funck never comes

back  I authorize my son Isaac Funck to sell all

the unsold lot and make a good title for

them  And the money arrived from them is to

be equally divided amongst the hole of the ???

Also Jacob Hardin, George Hardin Gary Hardin

Elizabeth Hardin is to have one half of their

Mother's legacy also I give to my wife

Elizabeth the dwelling house and two feather

beds and bedding as much of the household

furniture as she may think proper for her

self.  our cow also four fallowing hogs and

four goats and our breeding sows

 

 

Also my son William is to give to his mother

one third of all the grain that is seeded on the

land that I cleared,  also one third of the hay

land that I cleared,  also one third of the orchard

also one half of the garding  Also my son

Abraham is to pay to his mother fifty bushels of

good sound corn delivered in the cribs where

his Mother now lives  my son Isaac land I

have valued a four dollars and fifty cent per

acre and Abraham and William at seven of

that my first funeral expenses be paid and

all my last debts be paid and residue be

equally divided as before mentioned and lastly

I do constitute make and ordain John Snider Sr

to be my sole Executor of this my last Will

and Testament  Where upon I have hereto set my

hand and seal this the 19th day of August 1822

Be it remembered that on this day the last will and testament of Jacob Funk deceased, was produced and proven before me Henry W. Heth, Clerk of the Harrison Circuit Court by oaths of William Watson and Joseph Allot, subscribing witnesses to the same to record in my office in Will book "A" pages 84,85,86, the 3rd of October 1822

Date: August 19,1822

 

In the name of God, Amen.
I, Jacob Funck of Harrison County, IN. being sick of body, but of perfect mind and memory thanks be to God for it, calling to mind the mortality of my body and that it is once appointed for all men to die, do make and ordain this to be my last Will & Testament, revoking all former and other Wills & Testaments by me made or done, and constitute as follows and first.

I recommend my soul to God that gave it and my body to the grave to be buried in a Christian manner according to the discharge of my Executor, and as touching my worldly estate where with has pleased God to bless me with in this life. I give and bequeath in the following manner.

Item 1. I give and bequeath to my son Isaac 85 acres of land.
 I give to my son Abraham 75 acres of land.
To my son William 95 acres of land, to my daughter Liddy 8 acres of land, also one in Lot#29.
Also to my daughter Sary Barkison  3 lots of land lying in Amsterdam which she has to pay for the 3 lots, $36, Lots numbers as follows; # 24,25,26 

My daughter Liddy has to pay  for her eight acres of land and 1 lot $100.
Also I charge my daughter Catherine $45 for moving her from Shenandoah  County  in Virginia to the state of Indiana.
Also I charge my daughter Elizabeth $200 of money that she got out of my legacy.
Also I charge John Wall $245 due on a bond, also $207 of interest arising from the same. Also the said John Wall is to pay to each of the children $50 out of there mother’s legacy of the money that was lent to you by Jacob Funck.
Jacob Wall $40 at a lawful age,
George Wall $50 at a lawful age,
John Wall $50 at a lawful age,
Elizabeth Wall, at a lawful age,
Polly Wall $50 at a lawful age,
The balance to said John Wall is to keep for that is all he is out have out of my estate,
paid for Jacob Funck the Gunsmith to Joseph Shoving (?) John Byle, & Phillip Huffman, $182, paid to Wards his legacy, also if he ever comes to this place again he is to have the benefit of all the lots that now remain unsold in Amsterdam , excepting  the 2 lots #___. If the said Jacob Funck never comes back, I authorize my son Isaac Funck to sell all the unsold lots and make a good title for therein.
And the money arrived from the sale is to be equally divided amongst the hole of the __.
Also Jacob Hardin, George Hardin, Mary Hardin, Elizabeth Hardin, is to have one half  of their mother’s legacy.
 I give to my wife Elizabeth the dwelling house and 2 feather  beds and bedding as much of the household furniture as she may think proper for herself.  One cow,  also 4 ____, 4 shoats, and one breeding sow.
Also my son William is to give his mother one third of all the grain that is seeded on the land I cleared, also one third of the hay well stacked up, also one third of the Orchard , one half of the garden,
also my son Abraham is to pay his mother 50 bushels of  goof ground corn delivered in the cribs where his mother now lives,
my son Isaac land I  have valued at $4.50 per acre and Abraham and William at ____that my first funeral expenses be paid and all my just debts be paid and residue be equally divided as before mentioned.
Lastly I do constitute make and ordain John Snider Sr.to be my sole Executor of this my last Will & Testament.
Where upon I have hereto set my hand and seal this 19th of August 1822.
